The best way to resolve this situation is to create an unlivable situation for the current girlfriend. Find out where she works, gos to school, who her friends are, where she lives, where she shops, etc. Create a doubtful situation at most or some of these locations. For example, call her neighbors and say that she owes you money. Or, tell her close friends that she experimented in gay sex withyou. Or, tell her family that she has HIV. Or, tell the place she works at she has cheated on her taxes. this will eventually get back to the current boyfrind who will eventually look for a more suitable girlfriend. That will be you.
Trust me, if you pursue this, all of you will get hurt! Just get over him. Don't talk to him while he has a girlfriend. If he ends up breaking up with her then you can try to go for it.
P.s. if he really is flirting with you while he has a girlfriend, he's probably not the best boyfriend material.
im going through a similar situation, i like him and heard by a few people that he has told them he likes me,and although wer in a few classes together and talk and flirt, and over msn too, we have never mentioned liking each other and he doenst seem to intend on dumping her and i really really like him

You have to get over him, honey! You're just hurting yourself. If he has a girlfriend, he's kinda off limits. You wouldn't want his girl to get into a cat fight with you.
